City of Holyrood Dumpster Ordinance

ORDINANCE NO. 614

AN ORDINANCE REGULATING PLACING
OF DUMPSTERS ON ROADWAY, EXCEPTIONS
TO THIS ORDINANCE AND PROVIDING FOR PENALTIES FOR VIOLATIONS THEREOF.  

BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF HOLYROOD, KANSAS:
SECTION 1. It shall be unlawful to place any dumpster or receptacle on the city roadways, without approval of the Chief of Police prior to its placement on the roadway.  The Chief of Police shall only permit placement of a dumpster or receptacle on a roadway if it cannot be safely placed off the roadway.  If placed on the roadway it shall be placed with the longest side running parallel and within 12 inches to the curb (or to the end of the roadway if there is not curb).  The permit shall state the date at which the dumpster or receptacle must be removed; a permit can be extended by the Chief of Police.  If the Chief of Police denies a request for a permit for placement of a dumpster or receptacle, the requesting party may address the City Council and request they pass a resolution instructing the Chief of Police to issue the permit; the decision whether to pass such a resolution is in the sole discretion of the City Council.  
SECTION 2. Any Ordinance or any part of any ordinance in conflict with this ordinance is hereby repealed.
SECTION 4.  This Ordinance shall take effect and be in force from and after its publication in the official city newspaper.
